Dear MSSA Friends,

Yet another clone of Montana's HB 246 has been introduced in
Minnesota as HF2376, the "Minnesota Firearm Freedom Act."

Clones of our HB 246 have now been introduced in Alaska, Texas,
Tennessee [passed], South Carolina and Minnesota.  Ohio is now added to the
list of states said to be considering introducing a clone, bringing
that list to:  Georgia, Missouri, Ohio, Oklahoma, Louisiana, Kansas,
Arizona, Colorado, Wyoming, Utah, Idaho and Washington.

Curiously, despite the wealth of information on the Internet rumor
mill, both South Carolina and Minnesota popped up with introduced
bills without any advance warning.  I suspect it will happen
elsewhere without warning as well.  Stay tuned ...

As I understood Leo Berman (who introduced the bill), the bill never made it out of committee. Thus it never saw a vote. Since the legislature only meets once every 2 years in Texas, the subject is not even history.  Maybe my understanding is wrong but I don't think so.

If you Google for "firearms freedom act" you now get over 100,000
hits.  The FFA concept is getting a LOT of news coverage and a lot of
chatter on the Internet.

MSSA's domain about the FFA movement (firearmsfreedomact.com) is
getting lots of hits too.  It is now the first listing on this Google
search.  In addition to many visits from folks in the U.S., the site
stats say that in October this site has had visits from Internet
surfers in Canada, Italy, New Zealand, Russian Federation, Germany,
United Kingdom, Japan, Australia, Malaysia, Norway, Greece, Jordan,
Latvia, Poland, Romania, Seychelles, Brazil, Switzerland, and Pakistan.

Another State Introduces Firearms Freedom Act

According to a report published on the Tenth Amendment Center's web
site, "Introduced in the Ohio House on October 16, 2009, the 'Firearms
Freedom Act' (HB-315) seeks 'To enact section 2923.26 of the Revised
Code to provide that ammunition, firearms, and firearm accessories that
are manufactured and remain in Ohio are not subject to federal laws and
regulations derived under Congress' authority to regulate interstate
commerce and to require the words "Made in Ohio" be stamped on a central
metallic part of any firearm manufactured and sold in Ohio.'" The report

New Hampshire attorney E.F. Nappen writes that the Firearms Freedom Acts being introduced and enacted in various states are subject to " The Achilles Heels of the Firearms Freedom Act." He argues that the inclusion of NFA (National Firearms Act) items (e.g., suppressors or short-barreled rifles) in the asserted exemption from federal authority will cause the Acts to fail in court because the NFA regulates under federal tax power, not federal commerce clause power.

Utah Firearms Freedom Act

Dear MSSA Friends,

The Utah Firearms Freedom Act has been pre-filed with, and has
passed, an interim committee of the Utah Legislature.  Until it gets
an official bill number on December 1st, it is known as File #
0032.  Because the bill has been adopted as a committee bill of a
joint House/Senate interim committee, it will come to both the House
and Senate with definite legs when the full Utah Legislature convenes
in January.

The list of states with introduced FFA bills includes:  Alaska,

Guns made, sold and kept within state lines are exempt from fed rules, proposal says.

Alex Robinson wants his assault rifles on foreign battlefields and Utah gun racks alike, so a proposed Firearms Freedom Act exempting local-only sales from federal regulation isn't a game changer at his Salt Lake City machine shop.

Then again, Utah is gun country. Armed self-defense true believers see life and death in every constitutional affront. Many applaud a message bill that would preclude federal regulation of any guns made, sold and kept within state lines -- even as they acknowledge that such a law's prospects in federal court are dubious.

"There's absolutely no reason Utahns should be subject to some whimsical federal fancy created by media frenzy," Robinson said, blaming television crime dramas for part of the nation's gun aversion. People are entitled to any gun they want, he said, regardless of political swings.

Utah lawmakers this winter will take up a proposal to enact gun-rights legislation already on the books in Montana that carves out the in-state exemption. ...<snip>...
